ADULT PERPETRATORS OF CRIMINAL OFFENCES

BY TYPE OF DECISION, 2008

 

 

In 2008, the public prosecutor’s offices in the Republic of Croatia decided upon reports for 71 221 adult perpetrators of criminal offences, which was by 2.5% less than in 2007. The number of accused persons decreased by 2.7% and the number of convicted persons by 1.1%, as compared to the previous year.

 

The share of reported persons for criminal offences against property, which were the most frequent ones in 2008, was 54.1%, that of accused persons was 31.5% and of convicted persons 30.7%.

 

By type of pronounced sanctions, the most frequent was suspended imprisonment (70.0%), followed by unsuspended imprisonment (18.1%), unsuspended fine (8.9%) and judicial admonition (1.2%).

NOTES ON METHODOLOGY

 

Source and methods of data collection

 

On the basis of the Official Statistics Act (NN, No. 103/03), data on criminal offences of adult reported, accused and convicted persons are collected through the Statistical Report for an Adult against whom Proceedings Based on Crime Report and Interlocutory Proceedings Have Been Terminated (SK-1 form) and the Statistical Report for an Accused Adult against whom a Criminal Procedure Have Been Validly Terminated (SK-2 form).

 

Statistical reports are filled in by competent public prosecutor’s offices after the final decision has taken place as well as county and municipal courts of first instance that act after the criminal procedure has been validly terminated. Observation units are adult perpetrators of criminal offences that may be either direct perpetrators, accomplices, instigators or assistants.

 

Coverage

 

The statistical survey cover all adult perpetrators of criminal offences, whether reported, accused or convicted, in order to examine the volume and spread of crime for the whole territory of the Republic of Croatia.

 

Definitions

 

Crime in terms of statistical surveys covers an action from reporting a criminal offence to the valid termination of the legal proceedings by a public prosecutors’ office, that is, to pronouncing a valid court decision.

 

Adult perpetrator of criminal offence is a person who turned 18 years of age at the time of committing the offence and against whom proceedings based on crime report and interlocutory proceedings have terminated. The term also refers to accused persons (including those who were reported on the basis of private suit) against whom legal proceedings have validly terminated.

 

Person reported as known perpetrator is an adult perpetrator of a criminal offence against whom proceedings based on crime report and interlocutory proceedings have been terminated by a decision according to which: the report is rejected, interrupted investigation, the investigation is terminated, indictment or accusatory motion submitted.

 

Person reported as unknown perpetrator is an unknown person who was reported for a criminal offence with the public prosecutor, and who remains unknown even one year after the crime report was placed.

 

Accused person is an adult person against whom a proposed indictment, accusatory motion submitted or private suit is placed in court. It also refers to a person against whom criminal proceedings have been terminated with a valid court decision, by which the proceedings are terminated or crime report dropped, a person released from accusation, the accusation is rejected, or, for criminally insane persons, assignment to coercive accommodation  or a perpetrator is found guilty.

 

Younger adult person is a person who, at the time of committing an offence, turned 18 but not yet 21 years of age. Court may propose correctional measures consisting of special obligations, increased supervision and juvenile imprisonment penalty. In the case that a perpetrator did not turned the age of 21, court may propose assignment to a correctional institution.

 

Convicted person is an adult person that was found guilty, against whom penal measures have been imposed. Those measures may be: imprisonment, fine, educational measures, judicial admonition. It also includes persons who are found guilty, but released from sentence.
