OFFENDERS BY TYPE OF MISDEMEANOUR, 2008

 

In 2008, competent magistrate’s courts and competent administrative bodies in the Republic of Croatia made decisions on starting the misdemeanour proceedings for 277 631 adult offenders, which was by 2.4% less  than in 2007.

 

The number of accused juvenile persons decreased by 4.6%, while the number of legal entities and responsible persons increased by 21.8%, as compared to the previous year.

 

As for the number of misdemeanours, both adult and juvenile persons committed most misdemeanours in the field of safety in traffic (58.7% of adults and 65.9% of juveniles), while legal entities and persons in charge committed most misdemeanours in the field of economy (32.2%).

NOTES ON METHODOLOGY

 

Source and methods of data collection

 

On the basis of the Official  Statistics Act (NN, No. 103/03), data on misdemeanours committed by adult and juvenile persons as well as by legal entities and persons in charge are collected via regular statistical surveys, as follows: the Statistical Report on Responsible Adult Persons against Whom Misdemeanour Proceedings Have Been Validly Terminated (SPK-1 form), the Statistical Report on Responsible Juvenile Persons against Whom Misdemeanour Proceedings Have Been Validly Terminated (SPK-2 form) and the Statistical Report on Legal Entities and  Persons in Charge against Whom Misdemeanour Proceedings Have Been Validly Terminated (SPK-3 form).

 

Statistical reports are filled in by competent bodies: magistrates’ courts, tax administration offices, customs offices, harbour master’s offices, port authorities, air transport inspectorate and financial inspectorate.

 

The Misdemeanour Act (NN, No. 107/07) was put into effect on 1 January 2008 and, since then, it has been applied in statistical surveys.

 

Coverage

 

The statistical surveys cover all offenders of misdemeanours –adults, juveniles, legal entities or persons in charge – in order to examine the volume and spread of crime for the whole territory of the Republic of Croatia.

 

Definitions

 

Misdemeanours are violations of public order, social discipline or other social value that is not protected by the Criminal Code and other laws that define criminal offences.

 

In regard of statistical surveys, misdemeanours cover an occurrence that starts with pressing a charge for a committed misdemeanour and ends with a valid termination of proceedings done by a competent body.

 

Adult offender is a person who turned 18 at the time of committing a misdemeanour, and against whom misdemeanour proceeding has been validly concluded by either a decision on rejecting the proposal for misdemeanour proceedings, or a decision on dropping the charges, judgement on rejection of  charges, or a judgement of acquittal, or a decision by which person is found responsible.

 

Juvenile offender is a person who, at the time of committing a misdemeanour, turned 14 but not yet 18 years of age, and against whom misdemeanour proceedings have been validly concluded by either a decision on rejecting a proposal for misdemeanour proceedings, or a decision on dropping the charges, or a decision by which person is found responsible (only the juveniles who were sentenced by juvenile prison or fine).

 

According to the Misdemeanour Act (NN, No. 107/07), correctional measure is applied to juvenile offender of a misdemeanour by court‘s decision. In the pronunciation of the decision it is only stated which measure is applied, but the juvenile offender is not pronounced guilty of the committed misdemeanour.

 

Responsible person offender is a person in charge (director, accountant manager, cashier etc.) in a legal entity (trade company, state body etc) against whom misdemeanour proceedings have been validly concluded by either a decision on rejecting a proposal for misdemeanour proceedings, or a decision on dropping the charge, or a decision on imposing security measure without penalty, or a decision by which person is found responsible and fined.

 

In addition to imprisonment or fine, the law may also pronounce security measures such as prohibition to engage in a profession, activity or duty, expulsion of aliens from the territory of the Republic of Croatia, confiscation of objects or prohibition to drive a motor vehicle. Other security measures can be pronounced as well.
