U 2012. državna odvjetništva u Republici Hrvatskoj
donijela su odluke u povodu prijava za 1 054 pravne osobe – počinitelje
kaznenih djela, što je za 30,1% manje prijavljenih pravnih osoba nego u
2011. Broj optuženih pravnih osoba u odnosu na prethodnu godinu veći je za
44,0%, a broj pravnih osoba proglašenih odgovornima veći je za 62,2%.

In 2012, public
prosecutor’s offices in the Republic of Croatia decided upon crime reports
for 1 054 legal entities –
perpetrators of criminal offences, which was by 30.1% less than in 2011. The number of accused legal entities
increased by 44.0%, and the
number of legal entities recognised as responsible by 62.2%, as compared to the previous
year.

U 2012. broj optuženih pravnih osoba iznosio je 383,
a udio pravnih osoba koje su proglašene odgovornima iznosio je 50,4% (193
pravne osobe).

In 2012, there were
383 accused legal entities and the share of legal entities recognised as
responsible amounted to 50.4% (193 legal entities).

|
U 2012.
bila su najzastupljenija kaznena djela protiv sigurnosti platnog prometa i
poslovanja. Udio prijavljenih pravnih osoba za kaznena djela protiv
sigurnosti platnog prometa i poslovanja iznosio je 71,0%.

In 2012, criminal offences
against safety of payment and business operations were the most frequent
ones. The share of reported legal entities for these criminal offences was
71.0%.

|
Za
pravne osobe proglašene odgovornima izrečene su novčane kazne. U odnosu na
visinu izrečene novčane kazne, najučestalije su novčane kazne 10 001 – 20
000 kuna (77 pravnih osoba), potom novčane kazne 5 000 – 10 000 kuna (70
pravnih osoba).

Fines were imposed as
criminal sanctions for all legal entities recognised as responsible. Regarding the amount of pronounced fines, the most frequent ones
were those ranging between 10 001 and 20 000 kuna (77 legal entities) and
between 5 000 and 10 000 kuna (70 legal entities).

|
Za 24
pravne osobe sudovi su donijeli odluke o oduzimanju imovinske koristi
stečene kaznenim djelom.

courts made decisions on confiscation

Na
temelju Zakona
o službenoj statistici (NN, br. 103/03., 75/09., 59/12. i 12/13. – pročišćeni tekst), podaci o prijavljenim, optuženim
i osuđenim pravnim osobama prikupljaju se redovitim statističkim
istraživanjima koja se koriste sljedećim statističkim izvještajima:
Statistički izvještaj za pravnu osobu prema kojoj je postupak po kaznenoj
prijavi i prethodni postupak završen (obrazac SP-1) i Statistički izvještaj
za optuženu pravnu osobu prema kojoj je kazneni postupak pravomoćno završen
(obrazac SP-2).

On the basis of the Official Statistics Act (NN, Nos 103/03, 75/09, 59/12 and 12/13 – consolidated text), data on reported, accused and convicted legal entities are
collected by regular statistical surveys, in which the following
statistical reports are used: the Statistical Report for Legal Entities
against Which Proceedings Based on Crime Report and Interlocutory
Proceedings Have Been Concluded (SP-1 form) and the Statistical
Report for Accused Legal Entities
against Which Criminal Proceedings Have Been Validly Concluded (SP-2 form).

Statističke
izvještaje ispunjavaju nadležna državna odvjetništva nakon donošenja
konačne odluke te županijski i općinski sudovi koji sude u prvom stupnju
nakon što je postupak pravomoćno završen. Jedinice promatranja jesu pravne
osobe koje su počinitelji kaznenih djela.

Statistical reports are filled in by competent
public prosecutors’ offices after the final decision has taken place as
well as county and municipal courts of the first instance that act after
the criminal procedure has been validly concluded. Observation units are
legal entities – perpetrators of criminal offences.
|
|
|
|
|
|
Zakon o
odgovornosti pravnih osoba za kaznena djela (NN, br. 151/03., 110/07.,
45/11. i 143/12.) stupio je na snagu 24. ožujka 2004. U statističkim istraživanjima
primjenjuje se od 1. siječnja 2005.

Entities for Criminal Offences (NN, Nos

effect on 24 March 2004 and it has been applied in statistical
surveys since 1 January 2005.

every legal entity against which
proceedings based on crime report and interlocutory proceedings have been
concluded with a decision by which: the crime report has been
rejected, the investigation has been interrupted, investigation has been
terminated, or an indictment has been submitted.

pravna osoba jest svaka pravna osoba prema kojoj je kazneni
postupak pravomoćno završen odlukom suda o: odbačaju optužbe, obustavi
kaznenog postupka, oslobađajućoj ili odbijajućoj presudi ili je pravna
osoba proglašena odgovornom.

criminal proceedings have been concluded with a valid court decision, by
which the indictment has been dropped, proceedings have been terminated, a
