How to change the activity code of a business entity according to the NKD 2007.?

 

For changing the activity code according to the NKD 2007. it is necessary to submit a filled-in RPS-1 form signed by a person who filled in the registration form and by CEO/authorised person of the business entity. It is also necessary to enter information on financial information for the new activity for the last year and attach a short application for the change of activity code under section 13. The form can be downloaded here as RPS-1.doc or RPS-1.pdf.

In addition to the filled-in RPS-1 form, it is necessary to submit for consideration a copy of a historical excerpt from the Court Register that contains the activity to which you want to re-registered your business.

For obtaining the notification on classification in English (Eurocertificate) it is necessary to write an application for obtaining the Eurocertificate, including the name, identification number or OIB of the business entity for which the Eurocertificate is required (if a client comes in person, the application is not necessary, only the information on the name, identification number or OIB of the business entity).

We were informed that the Croatian Bureau of Statistics issued the Notification on classification according to the NKD 2007. for crafts, trades and free lances. Can you instruct us on how it is done?

 

The Croatian Bureau of Statistics keeps the Register of Business Entities based on positive laws.

On the entry in the Register of Business Entities, the Croatian Bureau of Statistics issues to business entities and parts thereof the Notification on the Classification of Business Entities according to the NKD 2007.

The Croatian Bureau of Statistics issues identification numbers and the Notification on classification according to the NKD 2007., but not for crafts, trades and free lances. Therefore, we kindly ask you to contact the Ministry of Economy, Entrepreneurship and Crafts, which keeps the Crafts Register.

 

How can crafts, trades and free lances obtain the Notification on classification according to the NKD 2007.?

 

The Croatian Bureau of Statistics is not competent to assign identification numbers in the aforementioned case.

The identification number will be assigned to a craft, trade and free lance by the body who registered it or whose member it is, if it meets the criteria for obtaining identification numbers defined by the aforementioned body.

 

 

 

How to register a foreign association, which has been registered in the Register of Foreign Associations, into the Register of Business Entities?

 

Foreign associations are not registered in the Register of Business Entities kept by the Croatian Bureau of Statistics and are not assigned a NKD code.

In order to regulate your status, please contact the Tax Administration, Avenija Dubrovnik 32, 10000 Zagreb, where you will be assigned a VAT ID number.

 

 

 

Which forms are needed to be filled in for the Register of Business Entities?

 

On the first registration of the business entity and on reporting of changes (activity, name of business entity, seat), the RPS-1 form must be filled in.

 

On the first registration of the part of business entity and on reporting of changes (activity, name of business entity, seat), the RPS-2 form must be filled in.

 

 

 

Is there any fee specified for entry/erasing/transcript of the Notification on classification according to the NKD 2007. and Eurocertifikat?

 

Requests of business entities for entry/erasing/transcript of the Notification on classification according to the NKD 2007. and Eurocertifikat received after 21 April 2018 are free of any charges.

 

 

  

Where is the National Classification of Activities 2007 – NKD 2007. published and what is the role of the Croatian Bureau of Statistics in its publishing?

 

The Croatian Bureau of Statistics keeps the Register of Business Entities pursuant to the Act on the National Classification of Activities (NN, No. 98/94), the Decision on the National Classification of Activities − NKD 2007. (NN, Nos 58/07 and 72/07) and the Ordinance on the Classification of Business Entities According to the National Classification of Activities 2007 − NKD 2007. (NN, Nos 55/16 and 35/18).

The National Classification of Activities 2007 – NKD 2007. is completely harmonised with the EU standard NACE Rev. 2 – Statistical Classification of Economic Activities in the European Community. It means that the NKD 2007. code is the same in all Member States and the translation is not needed.

The Register of Business Entities includes legal entities, natural persons engaged in activities according to the law, public government bodies (government administration bodies, other government bodies, local and regional self-government units, legal entities and other public authorities, legal entities established by the Republic of Croatia or by a local and regional self-government unit, legal entities performing public service, legal entities financed mostly or completely from the state or local and regional self-government units’ budgets, i.e. from public funds (taxes, provisions etc.) on the basis of a special act as well as trade companies in which the Republic of Croatia or the local and regional self-government units hold individual or joint majority ownership; hereinafter: business entities) classified according to the National Classification of Activities 2007 – NKD 2007.

On the entry in the Register of Business Entities, the Croatian Bureau of Statistics issues to business entities and parts thereof the Notification on the Classification of Business Entities according to the NKD 2007.

The Croatian Bureau of Statistics assigns to each business entity a seven-digit identification number, while the part of business entity is additionally assigned a four-digit ordinal number.
